Terms and Conditions

These Terms and Conditions govern your use of the Website www.storytimemagazine.com and apply to placing an order for a Subscription to, or an Issue of, Storytime magazine. Please read these terms and conditions carefully. Our Privacy Policy also forms part of these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions and Privacy Policy, you may not place an Order or make a Purchase.

By placing an order for a Subscription or Issue you shall be deemed to accept these Conditions and any specific conditions applicable to Storytime magazine set out elsewhere on this Site.

Your attention is drawn to the definitions of certain words and expressions used in these terms and conditions which are given below:

1 Definitions

“Conditions” means the standard terms and conditions of sale set out on the page of the Website headed “Website Terms and Conditions” on the date on which the Contract is made;

“Contract” means a contract made on these Conditions for the purchase of an Issue or for a Subscription;

“Issue” means a single issue of Storytime magazine, as described on the Site, which Storytime will supply in accordance with these Conditions;

“Order” means a request by you to make a purchase an Issue or a Subscription to Storytime magazine either by submitting the order via the Website or by submitting an order by telephone or by post;

“Subscription” means a subscription to Storytime magazine, as described on the Website, which Storytime will supply in accordance with these Conditions;

“Storytime” means Storytime Magazine Ltd about whom additional information is set out on the “Contact Us” page of the Site;

“Website” means the Internet site with the home page address www.storytimemagazine.com

“Writing” includes e-mail, fax and comparable means of communication.

2 Making an Order on our Website

2.1 Orders can be either Subscriptions or Issues as available on our Website.

2.2 Any Order placed by you for a Subscription or an Issue advertised on the Website shall be deemed to be an offer by you to purchase Subscription or issue pursuant to these Conditions. There will be no contract between you and us unless and until we accept your Order.

2.3 To make a purchase of a Subscription on our Website you will need to select which Subscription you wish to purchase; and then complete your details, and those of the recipient of the Subscription (if different from you), as well as your payment details.

2.4 We will then send you an initial acknowledgement by email and once we have checked whether we are able to meet your Order, we will send you a confirmatory email, at which point your Order will become a Purchase and shall conclude the Contract between you and us.

2.5 Once the order confirmation email has been sent to you, we will deliver your Subscription in accordance with Clause 4.1.

2.6 Orders will not be accepted from under-18s.

2.7 You warrant and undertake to us that: (a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these Terms and Conditions; (b) the information provided in your Order is accurate and complete; and (c) you will be able to accept delivery of the Issues or Subscription.

3 Price and Payment

3.1 The price of the Subscription and/or Issues shall be that stipulated on the Website or as otherwise advised by us to you via an advertisement or when making a purchase by telephone or post. The price is inclusive of VAT and, with regard to Subscriptions, delivery charges also.

3.2 When making a purchase of Issues other than Subscriptions, you may have to pay a delivery charge. We will inform you of this during the ordering process and before the Contract between you and us is concluded.

3.3 Subject to Clause 3.4, payment must be made prior to your Order being accepted and a Contract being formed.

3.4 You will have different payment options available to you when purchasing a Subscription and these will be brought to your attention during the ordering process and before the Contract is concluded.

3.5 When making a Purchase via our Website, payment must be made in Sterling, US dollars, or euros either by credit or debit card. Direct Debit payments can be accepted from UK bank accounts only. All card transactions are processed through a secure payment gateway. All credit/debit card Purchases are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason authorise payment to us for a particular purchase, we will not accept your Order.

4 Delivery

4.1 Where you have purchased a Subscription, unless we agree otherwise with you, the first delivery may take up to six weeks to be delivered, with the next and subsequent issues being delivered at monthly intervals. Unless we agree otherwise with you, individual Issues will be delivered within 30 days of conclusion of the Contract.

4.2 We shall use our reasonable endeavours to meet any date agreed for delivery. Notwithstanding the foregoing, we shall not be liable for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

4.3 Delivery of the Subscription or Issues shall be made to the delivery address specified in the Order and you shall make all arrangements necessary to take delivery of the Subscription or Issues whenever they are tendered for delivery.

4.4 The Goods will be at your risk from the time of delivery. Ownership of the Goods will only pass to you upon the later of: (a) delivery of the Goods; and (b) receipt by us of full payment of all sums due in respect of the Goods (including delivery charges).

5 Cancellation and Returns

5.1 You may cancel a Contract for a Subscription, without cause, and receive a full refund of the price and any delivery charge paid by you, provided you notify us in writing, fax, or email of said cancellation within 14 days from the day after you receive your first issue, (the “Cooling Off Period”) or, for online sales, 14 days from the confirmatory email sent to you. In the case where the issue has been delivered to a third party on your behalf, the cancellation period shall apply from the day after the third party receives the Goods. All cancellation notices should be directed to the contact details set out in Clause 7. If you pay by Direct Debit you must also cancel the Direct Debit with the bank otherwise your bank may continue to make payments.

5.2  In the event that you serve a valid notice of cancellation in accordance with Clauses 5.1 we shall provide you with a full refund of the price plus delivery charges (if appropriate) within 14 days of receipt of the returned goods. It is your responsibility to return any Goods to us within twenty-one days of cancellation. Returned goods must clearly show the order number obtained from us on the package and sent to the address noted below in Clause 7. You will be responsible for the costs in returning the goods to us and should you fail to return the goods to us within the timeframe, we are entitled to deduct an amount not exceeding the direct costs of recovering the goods from you from the money we are obliged to refund you, unless you are returning the goods because they are defective or in any other circumstances you are entitled to reject the goods under law. On cancellation, the goods shall remain at your risk until returned to us and you are required to take reasonable care of the goods until that time. Where returned goods are found to be damaged due to your acts or omissions, you will be liable for the cost of remedying such damage or the replacement cost of the relevant goods.

5.3  Should you wish to cancel a recurring subscription before it renews, you must give us at least 7 days’ notice before the renewal date. For example, if you had taken out an annual recurring subscription on 15th January 2023, the renewal date would be 15th January 2024, and we would need to receive your notice, in writing, by 8th January 2019. If you pay by Direct Debit you must also cancel the Direct Debit with the bank otherwise your bank may continue to make payments. Please note the start date of your subscription is the date your order was placed, not the date that the first payment was taken. The contact details to cancel are in Section 7, below.

5.4  Should you wish to cancel a trial subscription before upgrades to a full subscription, you must give us at least 7 days’ notice before the upgrade date. For example, if you had taken out a four month trial subscription on 15th January 2024, the renewal date would be 15th May 2024, and we would need to receive your notice, in writing, by 8th January 2019. If you pay by Direct Debit you must also cancel the Direct Debit with the bank otherwise your bank may continue to make payments. Please note the start date of your subscription is the date your order was placed, not the date that the first payment was taken. The contact details to cancel are in Section 7, below.

6 Liability

6.1 If you notify Storytime of any valid claim in respect of any issue of Storytime which is based on any defect in the quality or condition of such issue, Storytime shall at your option either replace the relevant issue or product free of charge or refund the issue.

6.2 Should Storytime be unable to supply you with issues of Storytime due to circumstances beyond its control, Storytime will notify you of such circumstances and if those circumstances continue for a period of 3 months either you or Storytime may terminate the order for the Issue or (as appropriate) the Subscription immediately. Any advance payments made by you for issues not delivered by the date of termination shall be refunded.

6.3 Storytime will not be responsible for any loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure or any other indirect or consequential loss or business loses.

6.4 From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s) or the views expressed within them. We have no responsibility for the content, nature or availability of the linked website(s).

6.5 Nothing in these Terms and Conditions affects your rights at law (including your right to receive a refund in respect of any defective goods we sell to you).

8 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales including in relation to any non-contractual obligations arising therefrom. Any dispute arising out of such use of the website or the supply of any products and services by us is subject to the laws of England and Wales including in relation to any non-contractual obligations arising therefrom.
